As APC Ask Court To Award Cost Against Melaye
The court of Appeal on Thursday reserved judgment in the appeal filled by Dino Melaye to upturned the victory of Senator Smart Adeyemi in the last year Kogi West rerun senatorial election.
Adeyemi (APC) had defeated Melaye (PDP) with the highest margin in the history of the Senatorial district; yet, Melaye petitioned the Election tribunal which last month upheld the victory of Adeyemi at the poll.
Not satisfied, Melaye approached the Appeal court to upturned the unanimous decision of the 3-man panel of the Tribunal, seeking to be declared winner of the poll.
As appeal resumes hearing on the suit, counsel to Smart Adeyemi, (2nd respondent), Dr Otitoju Oladapo urged the court to dismissed Melaye’s Appeal, as it’s lacking in merit.
Dr. Dapo who adopted his brief filed on July 11, said the appeal is baseless and a waste of court time, “I seek your lordships to rely on the records of the trial (Tribunal) court as it speaks for itself in details; to dismiss the appeal as it lacks merits”.
Counsel to 1st respondent, the Independent National Electoral Commission, (INEC), Barr. Alashy Chris prayed the court to dismissed the appeal for lacking in merit and upheld the judgment of the trial Tribunal.
He submitted three briefs of arguments to support his prayers. Counsel to APC, Barr. Mohamed Abdulahi also urged the lordships to dismiss the appeal, going further to ask the court to award substantial cost against Melaye.
The court after listening to the adoptions of addresses reserved judgment with a date to be communicated through the counsels.
